Laurence Parisot had qualified this preamble of shameful

Whereas last weekend, the order of extension of the agreement on low-wage increased of 200 euros net, signed on 4 March in Pointe-à-Pitre between the LKP collective and the minority employers organisations, remains blocked. Because of the opposition of two employers expressed Friday at the commission which examined, for opinion, the draft decree, the Ministry of labour is required to refer once again to this House. It will be on April 3.

Referred to as "Jacques Bino accord", the name of the Guadeloupe unionist killed during the long crisis of 44 days, the text signed in the State commits, to this day, be a part of the business, between 15,000 and 30,000 employees according to estimates, then some employees 45,000 are potentially affected. The Medef and CGPME indeed refused, on 4 March, initialing the agreement.

Taking into account the opposition, the Ministry of labour has submitted an order for extension which proposed to exclude two contentious points of the agreement. Firstly its preamble, which, to him alone justifies, in the eyes of the main employers, their refusal. It is notably denounced in these lines an economic and social situation "resulting from the sustainability of the model of the plantation economy. Laurence Parisot had qualified this preamble of "shameful". The disappearance of this almost ideological tension point therefore had to lift a first obstacle.

At the request of the employers, the Government also proposed not to extend the "convertibility clause". Article 5 of the agreement provides that at the end of the period of three years of aid from the State (100 euros per month via the RSTA) and (one year) communities, the increase in net EUR 200 is integrated in the compensation of employees "to the burden of employers. Available against which the Medef, such as the CGPME, are headwind in reason, explain, heavy and serious impact that it would then have on the finances of the companies.

Broken balance

"Cannot hire companies on increases that they will not be able to take", said a few days ago Jean-François Roubaud, President of the CGPME. Their giving reason, the Department estimated that could prejudge the date of the signing of the agreement of the economic situation that will prevail in three years, at the scheduled end of aid from the State.

Finally, the Medef objected to the method of calculation adopted by Bino agreement to determine the bases of increase, in this case the hourly wage of base (excluding bonuses). The employers ' organisation recommends an annual basis incorporating the 13th month and different bonuses. But, despite some reservations, the Ministry of labour did not object to the extension of this article. In fine, the Medef who joined in opposition by the FNSEA, angry for not having been associated negotiation, the draft decree of extension of the agreement is therefore postponed until better days.

As a result, the balance of the agreement, on the ground, "is broken", noted a trade unionist of the CFDT, since between businesses that have signed, those still trying to negotiate individually and finally those who participate in the agreement, the situation of the employees will be more diverse.
